Terms of Service & EULA

These Terms of Service (the “Terms”) form a legally binding agreement between you and Lumio Studio (“we”, “us”, “Lumio”), publisher of the HabitAdd mobile application and the website at habitadd.com (together, the “Service”). By creating an account, downloading, installing, or using HabitAdd you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

These Terms also constitute the End User License Agreement (EULA) governing your use of the iOS application. Where the App is distributed through the Apple App Store, the Apple-specific terms in Section 13 below apply and the agreement is between you and Lumio (not Apple).

You must be at least 13 years old (or 16 in the EEA / UK) to use HabitAdd. If you create an account, you agree to provide accurate information and to keep your credentials secure. You are responsible for all activity under your account.

You may delete your account at any time from inside the app or by emailing habitadd@lumiostudio.co.

Subject to your compliance with these Terms, Lumio grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install and use the HabitAdd application on devices you own or control, for your personal, non-commercial use.

You may not (and may not permit anyone else to): (a) copy, modify, or create derivative works of the App; (b) reverse-engineer, decompile or attempt to extract the source code; (c) rent, lease, sublicense, sell or otherwise commercialize the App; (d) remove any proprietary notices; (e) use the App in violation of any law or to infringe any third-party right.

HabitAdd offers a free tier and a paid subscription (“Premium”). Premium unlocks features such as cloud sync, unlimited habits, deep work tracking, peer/group habits and analytics. Subscriptions are billed through your Apple ID at the price displayed in the App Store at purchase time. Prices may vary by country.

Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price unless cancelled at least 24 hours before the period ends. You can manage and cancel your subscription at any time in Settings → [your name] → Subscriptions on your Apple device. Removing the App does not cancel your subscription.

Free trials. If we offer a free trial, your subscription begins at the end of the trial unless you cancel before the trial ends. Apple may not refund the unused portion of a billing period — refunds are at Apple’s discretion.

You retain all rights to the habit data, notes, group/peer relationships and other content you create in HabitAdd (“Your Content”). You grant Lumio a limited license to host, store, transmit, and display Your Content solely to operate and improve the Service for you, and (where applicable) to deliver it to other users you have explicitly invited (e.g., peer-habit partners, group members).

You represent that Your Content does not infringe any third-party right and that you have the right to upload it. We may remove content that violates these Terms or applicable law.

You agree not to use HabitAdd to:

• Harass, abuse, threaten or harm any other user (especially in social features).
• Upload unlawful, infringing, defamatory, obscene or otherwise harmful content.
• Attempt to access another user’s account or data without permission.
• Probe, scan or test the vulnerability of the Service.
• Interfere with or disrupt the Service, including by sending automated requests.
• Use the Service to send spam or unsolicited messages.

We strive to keep HabitAdd available 24/7, but we don’t guarantee uninterrupted availability. We may modify, suspend or discontinue features (or the entire Service) at any time. Material changes will be communicated in the app or by email where practical.

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Lumio disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. HabitAdd is a productivity aid — it is not a medical, mental-health, or therapeutic service.

To the fullest extent permitted by law, Lumio (and its officers, employees and partners) shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Lumio’s total cumulative liability for any claims relating to the Service shall not exceed the amount you paid Lumio for the Service in the twelve months preceding the claim (or USD 50, whichever is greater).

You agree to defend, indemnify and hold harmless Lumio from and against any claims, damages, liabilities, costs and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) Your Content.

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or use the Service in a way that could expose us or other users to legal liability. You may terminate at any time by deleting your account and uninstalling the App. Sections that by their nature should survive (including 5, 8, 9, 10, 12) survive termination.

These Terms are governed by the laws of Türkiye, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Istanbul, Türkiye, except where mandatory consumer-protection law in your country of residence applies.

The following terms apply to your use of HabitAdd as a Licensed Application obtained through the Apple App Store, and supplement the Terms above. To the extent there is any conflict, the following terms prevail with respect to the Apple App Store distribution.

• Acknowledgement. This EULA is between you and Lumio Studio, not Apple. Lumio is solely responsible for the App and its content.
• Scope of License. The license is limited to a non-transferable license to use HabitAdd on any Apple-branded products that you own or control and as permitted by the Apple Media Services Terms.
• Maintenance & Support. Lumio is solely responsible for providing any maintenance and support services for the App. Apple has no obligation to furnish any maintenance or support services.
• Warranty. Lumio is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Lumio’s sole responsibility.
• Product Claims. Lumio, not Apple, is responsible for addressing any claims relating to the App or your use of it, including: (i) product-liability claims, (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer-protection, privacy or similar legislation.
• Intellectual Property Rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual-property rights, Lumio (not Apple) is solely responsible for the investigation, defense, settlement and discharge of any such claim.
• Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Developer Contact. For questions, complaints or claims with respect to the App, contact Lumio Studio at habitadd@lumiostudio.co.
• Third-Party Terms. You agree to comply with any applicable third-party terms when using the App.
• Third-Party Beneficiary. You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

We may update these Terms from time to time. The “Effective” date at the top reflects the latest version. For material changes we will notify you in the app or by email before they take effect. Your continued use of the Service after the effective date constitutes acceptance.
